Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service, which may be updated by us from time to time without notice. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website without notice.

You must not misuse this Website. All such rights are reserved by Mimco and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, duplicate, copy, sell, distribute or otherwise reproduce or exploit, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please refer to our Delivery page for further information.
In order to contract with Mimco you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Mimco retains the right to refuse any request made by you.
Our contract
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.
Pricing And Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors (including processing errors) may occur. If we discover an error in the price or payment of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.
The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
Mimco will match any price you see online for the same item. The item must be identical in size, colour and style.
Payment
Our website accepts payments using Visa, MasterCard, Amex, Afterpay, PayPal, Alipay and Apple Pay. We will place a pre-authorisation charge of $1 on your nominated payment method for the first time it is entered on our website. Once your payment method has been validated, upon clicking “PLACE ORDER” we will debit the funds from your nominated form of payment immediately for the full order amount. Pre-authorisation charges will clear within 3 - 5 working days after placing your order (depending on your bank's or payment methods practices). For stored payments in your MIMCOLLECTIVE account, no pre-authorisation charges will occur unless your stored payment is no longer valid.
Discount Codes
We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.The conditions of use relating to any discount code will be specified at the time of issue.
Gift Cards
Gift cards may be physical gift cards or E-Gift cards that are sent in an email. Gift cards are issued in specific currencies, so that cards issued in New Zealand dollars are redeemable in New Zealand stores and on the new Zealand website, whilst cards issued in Australian dollars are redeemable in Australian stores and on the Australian website. They are not redeemable for cash or travellers cheques. No change will be given for a purchase made with a gift card. The gift card expires 3 years from the date of issue (or date of purchase for E-Gift Cards). E-Gift cards may take up to 48 hours to be delivered to the recipient's email after purchasing online. Gift cards are partially redeemable and it is up to the cardholder to use the full value within the validity period. Any unused balance will not be refunded or credited when the card expires. When the cost of a purchase exceeds the available card balance, the cardholder will be required to make up the difference with an alternate form of payment. Your gift card is treated as a form of tender and cannot be used on Afterpay, Paypal, Alipay or Apple Pay orders. Gift Cards should be treated like cash. Mimco disclaims all responsibility for lost or stolen cards. Gift Cards may not be purchased with reward points, and their purchase will not earn reward points.

These Terms of Service are to be construed in accordance with the laws of Victoria, Australia and in the event of any dispute or claim associated with these Terms of Service, that dispute or claim shall be subject to the exclusive jurisdiction of Victoria, Australia.

Any provision in these Terms of Service which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms of Service or affecting the validity or enforceability of that provision in any other jurisdiction.

1. The Member Terms and Conditions set out in this document concern the operation of the MIMCollective Loyalty Program, the use of the MIMCollective Card, and any promotional activity and loyalty transactions that arise as a consequence of the MIMCollective Loyalty Program.
2. Individuals who join the MIMCollective Loyalty Program agree to be legally bound by these Member Terms and Conditions.
3. The Member Terms and Conditions may be modified at any time without prior notification by Mimco in its absolute discretion. Any modification to the Member Terms and Conditions may be applied to a Member retrospectively.
4. In its absolute discretion, Mimco reserves the right to cancel, terminate, modify or suspend the MIMCollective Loyalty Program or any aspect of it at any time and without notice.
5. Mimco will not accept any liability for any Member Email that is misdirected, lost or not received.
6. Mimco will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the MIMCollective Loyalty Program.
7. Mimco may collect personal information from Members for the purpose of facilitating the MIMCollective Loyalty Program. Personal information will be handled in accordance with Mimco’s Privacy Policy- see our privacy policy here.
8. Mimco may, at any time and in its absolute discretion, require a Member to provide to Mimco proof of identification (in a form requested by Mimco) for Mimco to verify the authenticity of their MIMCollective membership and compliance with these Terms and Conditions. Failure to provide proof of identification may result in termination of a Member’s involvement in the MIMCollective Loyalty Program.
9. Mimco will not be liable for any tax liability incurred by a Member in connection with the MIMCollective Loyalty Program, including that incurred in the provision and/or utilisation of Rewards.
10. These Member Terms and Conditions are to be read in conjunction with any additional conditions associated with Rewards, including without limitation with the Website Terms and Conditions and other relevant Mimco policies and or terms and conditions.
11. Mimco’s decision in relation to all matters arising in relation to the MIMCollective Loyalty Program is final and binding.
12. Any failure or delay by Mimco in exercising its rights under these terms does not constitute a waiver of those rights. Any waiver by Mimco must be in writing and signed by an authorised officer of Mimco.
13. Nothing in these Member Terms & Conditions is intended to contravene any applicable law. To the extent that any provisions in these Member Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Member Terms & Conditions.
Definitions
14. “Anniversary” means the date 12 months from: a Member's Join Date; or the date that Member changed tiers, whichever is the later.
15. “Effective Date” means 3 November 2016;
16. “Join Date” means the date a Member joins the MIMCollective Loyalty Program.
17. “Member” means individuals who sign up to the MIMCollective Loyalty Program.
18. “Member Emails” means emails that are sent from Mimco to a Member including emails about the individual's membership, the MIMCollective Loyalty Program, special offers, discounts, competitions and events.
19. “Member Profile” means the personal details of the Member.
20. “Member Terms and Conditions" means these terms and conditions as amended from time to time.
21. “Mimco” means Mimco Pty Ltd ABN 13 067 573 291 and its authorised representatives.
22. “MIMCollective Card” means the membership card, whether in plastic or digital form, issued by Mimco to a Member; or where no Membership card is issued, the Member login allocated to the Member.
23. “MIMCollective Loyalty Program” means the loyalty program operated by Mimco providing Members with access to Rewards in accordance with these Member Terms and Conditions.
24. “Our Store To Your Door” means an online order placed on behalf of a Member by Mimco staff where an item is not available in-store.
25. “Rewards” means rewards or other benefits given to Members as a consequence of purchasing behaviours, incentives and/or promotions.
26. “12 Month Spend Balance” means a Member's net cumulative spend (i.e. after all discounts, returns etc have been applied) on Valid Purchases in the previous 12 months. For example, a Member's Spend Balance as at the period 1 March 2016 will be their cumulative spend on Valid Purchases during the period from 1 March 2015 to 23:59:59 on 29 February 2016. A Member's 12 Month Spend is reviewed daily and any Valid Spend from transactions outside of this period will be removed. Valid Spend from transactions made in store is added to a Member's 12 Month Spend on the day the transactions is made and Valid Spend from transactions made online or through Our Store To Your Door is added to the Member's 12 Month Spend Balance on the day the order is dispatched (not made).
27. “Technical Issues” means the technical malfunction of any telephone network, connection or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website or intranet site.
28. “Tier Spend Balance” means a Member's net cumulative spend (i.e. after all discounts, returns etc have been applied) on Valid Purchases whilst they are a member of that tier. Valid Spend from transactions made in store is added to a Member's Tier Balance on the day the transactions is made and Valid Spend from transactions made online or through Our Store To Your Door is added to the Member's Tier Balance on the day the order is dispatched (not made). For customers granted 12 months anniversary extension in April 2020 Tier Spend Balance will be calculated on the net cumulative spend on Valid Purchases made in the previous 12 months.
29. "Valid Purchases" means all purchases of Mimco merchandise made:
1. at Mimco’s retail boutiques;
2. at Mimco outlet stores;
3. at Mimco’s App;
4. at Mimco's Website;
5. in store at select David Jones stores in Australia or
6. in store at select Myer stores in Australia.
excluding : any portion of a purchase made using a gift card, any portion of a purchase that constitutes delivery costs; and selected merchandise which Mimco determines will not be eligible to earn Rewards.
Any purchases which are returned for a refund will not constitute Valid Purchases. For the avoidance of doubt, purchases of Mimco merchandise made at Myer’s websites, David Jones’ websites, The Iconic and any other channel not expressly listed at (1) to (6) above, will not constitute a Valid Purchase.30. “Website” refers to the Mimco website mimco.com.au or mimco.co.nz where details of the MIMCollective Loyalty Program (including the most up to date Terms and Conditions) can be found and where Members can monitor their Member status and Member Profile.
MIMCollective Membership
31. The minimum age for Members must be at least 15 years. Whether you are in Australia or New Zealand, if you are under the age of 18, you must have your parent or guardian's approval to join the MIMCollective Loyalty program. Your parent or guardian will need to read these Terms & Conditions.
32. If you are a Mimco team member, or eligible for a Mimco staff discount, you are not eligible to join the MIMCollective Loyalty program.
33. An individual becomes a Member as at the Join Date. Completion of the sign-up process to the MIMCollective Loyalty Program is deemed acceptance of the Member Terms and Conditions.
34. An individual is deemed to be a Member when they sign up in store or online and or use their MIMCollective Card during a transaction and/or earn or redeem Rewards.
35. When joining in-store, a sales consultant will record the individual's full name, email address, and postcode at the register. Other details such as a phone number may be optionally recorded. An individual may update their Member Profile at any time by logging in to the Website and clicking on the 'My Account' link on the Website. It is the Member's responsibility to update their Member Profile including their email, surname, phone and postal address. If a Member has not provided or updated Mimco with correct details, Mimco may not be able to contact the Member about their membership, Rewards, special offers or entry to competitions.
36. Signing up to the MIMCollective program online may be completed by following the prompts in the checkout process.
37. Upon joining the MIMCollective Loyalty Program, a Member will be allocated to a MIMCollective Loyalty Program tier on the basis of the transaction spend that qualified them to apply for membership. This allocation is outlined below.
38. Any Members who were MIMCollective members prior to the Effective Date will be allocated to a MIMCollective Loyalty Program tier on the basis of the Member's Spend Balance for the period 3 November 2015 to 2 November 2016 and deemed to accept the Member Terms and Conditions on and from the Effective Date.
39. At any time, Members may only have one account to the MIMCollective Loyalty Program and one corresponding MIMCollective Card. Members may not transfer their account or Rewards to another person.
40. Free standard delivery for orders over $100 will not be available for new MIMCollective members, if shopping on the same day as joining the loyalty program. However free standard delivery may be available to new MIMCollective Members if specified spend thresholds are met. If free delivery is not offered when eligible please contact Customer Care directly via Live Chat or call 1800 994 340 between 9am - 5pm AEST, Monday - Friday, with your order number to request a refund if eligible. Note, Customer Care are only able to refund the delivery cost on an order, once the full order has been dispatched.
41. New MIMCollective memberships created online up to 48 hours prior to and during promotional periods will be unable to redeem the offer online. New members will be able to redeem the offer in a Mimco retail boutique, through the Mimco App, in store at select David Jones stores or in store at select Myer stores. If you are experiencing difficulties with redeeming an offer or benefit online, please contact our Customer Care team for assistance. Mimco is unable to amend any online orders once they have been placed and will not be able to reflect any offer discounts after order placement.
42. Mimco reserves the right to modify, refuse or terminate a Member's account to the MIMCollective Loyalty Program without notice or reason and at its absolute discretion.
43. Mimco reserves the right to withdraw a Member's Tier Status at any time without notice or reason and at its absolute discretion. In the event that Mimco withdraws a Member's Tier Status, the Member's Tier Status will drop to the appropriate Tier Status based on the Member's Spend Balance as at the date of being withdrawn from their current Tier Status.
44. A Member may end their membership at any time by contacting the Mimco Customer Care team via one of the methods outlined at https://www.mimco.com.au/contact-us/.
45. By joining the MIMCollective Loyalty Program, an individual consents to Mimco contacting them to provide them with consumer or marketing information and notifying them of Rewards or other products and special offers.
MIMCollective Card
46. With effect from Monday 14 March 2022, Mimco will no longer issue new plastic MIMCollective Cards. This does not affect the validity of existing plastic MIMCollective Cards which remain valid. Plastic MIMCollective Cards remain the property of Mimco at all times.
47. Digital MIMCollective Cards are not currently available to new MIMCollective Loyalty Program members. Members with existing digital MIMCollective Cards can continue to use their MIMCollective Card that is downloaded in their Digital Wallet.
48. Only one MIMCollective Card can be presented for each transaction.
49. To record your transactions and otherwise utilise the benefits of the MIMCollective Loyalty Program, Members must present their MIMCollective Card to a Mimco team member when making a purchase in-store. If you are unable to present your MIMCollective Card, you can present an alternative form of identification displaying your name and address in order to verify the membership. For purchases online, Members can log into their MIMCollective account on the Website.
50. A current MIMCollective Card (or photo identification as described above) must be presented by the Member to access membership discounts, Rewards and other Loyalty Program Benefits. If we are unable to verify your membership in the MIMCollective Loyalty Program, you may not be able to utilise the benefits of the program. We may also not be able to record your transactions which may impact the level of membership benefits available to you.
51. Members must notify Mimco immediately if their MIMCollective Card is lost, stolen or misplaced. Mimco does not accept any responsibility or liability for any loss of a Member's MIMCollective Card or for any unauthorised redemption of Rewards.
52. If Mimco invites a Member to a special event they may be required to show their MIMCollective Card or photo identification to gain entry or any applicable offers or discounts.
Earning MIMCollective rewards
53. The MIMCollective Loyalty Program operates by attributing different Rewards (as nominated by Mimco from time to time) to the various tiers of the MIMCollective Loyalty Program.
54. Members are allocated to tiers on the basis of their Spend Balance and Tier Spend Balance.
55. The currency in which Rewards are earned will be in AUD unless your country of residence in your Member Profile is New Zealand. For example, a Valid Purchase made in New Zealand will earn Rewards in NZD.
56. When a Member completes a transaction and identifies themselves in-store by presenting their MIMCollective Card or photo identification, the net amount of the Valid Purchase is added to their Spend Balance and Tier Spend Balance on the day after the transaction is made.
57. Where a Valid Purchase is made in store, Rewards will be issued based on the day the order is made in store and loaded onto the Member's account approximately 48 hours after the Valid Purchase is made.
58. When a Member completes a transaction online on the Website and identifies themselves by logging into their online Member account, the net amount of the Valid Purchase is added to their Spend Balance and Tier Spend Balance on the day after the order is dispatched, not at the time of order placement. Should an order be split and dispatched on different days ability to earn rewards may vary.
59. Where a Valid Purchase is made online on the Website or by an Our Store To Your Door, Rewards will be loaded onto the Member's MIMCollective Card approximately 48 hours after time of dispatch of first item in an online order and will expire depending on the members tier status.
60. Mimco will endeavour to notify the Member via email when the Member is entitled to a Reward or changes to a different tier in the MIMCollective Loyalty Program. If a member unsubscribes from Mimco Member Emails their Rewards balance will be viewable online only.
61. At its sole discretion, Mimco may update a Member account with a Reward as a consequence of a purchasing behaviour, incentive and/or promotional activities.
62. Mimco reserves the right to withdraw, cancel or vary the Rewards without notice and at any time for any reason whatsoever in its absolute discretion including without limitation Rewards awarded in error or Rewards earned fraudulently.
63. Rewards cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including (but not limited to) gift vouchers, gift cards, cheques and credit notes.
64. Rewards cannot be earned using other Rewards as part of the transaction. E.g. If a Member transacts using $80 in Cash and $35 in Rewards, they are not entitled to the $15 Reward for Members who spend over $100 (despite the transaction adding up to over $100); the Member must spend $100 in total excluding any Rewards.
65. If a Membership is terminated from the MIMCollective Loyalty Program, all outstanding and future Rewards will no longer be valid and will be rendered null and void.
66. Only one transaction Reward will be earned and uploaded to a Member's MIMCollective Card per day.
67. When a Member returns a purchase in-store, online, or via post, the net amount of the transaction will be deducted from the Member's Spend Balance and Tier Spend Balance and the Reward that was previously awarded will be adjusted or reversed.
68. Spend & Earn Rewards can be earned from Valid Purchases using Buy Now Pay Later providers such as Afterpay and Klarna. Spend & Earn Rewards earned from a purchase using a Buy Now Pay Later provider will be issued approximately 48 hours after purchase in-store and approximately 48 hours after order dispatch if the transaction was made online.
69. If an online order is cancelled, Mimco may adjust or reverse Reward that were previously awarded to a Member in that transaction.
70. Members can view their Rewards at any time by logging into their account online on the Website.
MIMCollective tiers & associated rewards
73. Members are allocated to tiers on the basis of their Spend Balance (a Member's 'status') in the following manner and as depicted in the pyramid diagram below. The reference to currency below is to AUD and all Tier Spend will be assessed against AUD spend regardless of the location of the Member or the currency in which the Member is shopping.
1. Black Status: Members whose Spend Balance is $2500 or more;
2. Rose Gold Status: Members whose Spend Balance is $750 or more;
3. Silver Status: Members whose Spend Balance is $300 or more, but less than $750;
4. Member Status: Members whose Spend Balance is less than $300;74. A Member may move at any time to a higher tier in the MIMCollective Loyalty Program when that Member's Spend Balance qualifies them to move to the higher tier.
75. On each Member's Anniversary, a Member's status will be determined by the Member's Tier Spend Balance and the Member will, depending on the Member's Tier Spend Balance, either retain their Member Status or be moved to a different Tier. The Member's status will then remain in that tier until the next Anniversary unless the Member's Spend Balance (or an invite from Mimco) qualifies the Member to move to a higher Tier.
76. If at any time a Member's status changes resulting in the Member changing tiers, the Member's Tier Spend Balance reverts to zero dollars. A Member's Tier Spend balance from the previous tier does not carry over to the Member's new Tier Spend Balance.
77. All Valid Purchases will contribute to a Member's Spend Balance.
78. The following on-going Rewards & Incentives are available to all members and are subject to change:
1. $15 Reward when they spend $100 from Tuesday 19 February 2019: Members must spend $100 in total in one day after all Rewards have been redeemed and all discounts have been applied in order to receive the $15 Reward which expires 30 days after the date of issue for Member Status Tiers, 50 days for Silver Status Tiers, 80 days for Rose Gold Status Tiers and 130 days for Black Status Tiers.
2. $25 Reward when they spend $250 from Tuesday 19 February 2019: Members must spend $250 in total in one day after all Rewards have been redeemed and all discounts have been applied in order to receive the $25 Reward which expires 30 days after the date of issue for Member Status Tiers, 50 days for Silver Status Tiers, 80 days for Rose Gold Status Tiers and 130 days for Black Tiers.
3. $50 Reward when they spend $500 from Tuesday 19 February 2019: Members must spend $500 in total in one day after all Rewards have been redeemed and all discounts have been applied in order to receive the $50 Reward which expires 30 days after the date of issue for Member Status Tiers, 50 days for Silver Status Tiers, 80 days for Rose Gold Status Tiers and 130 days for Black Status Tiers.
4.$75 Reward when they spend $750 or more from Friday 11 June 2021: Members must spend $750 in total in one day after all Rewards have been redeemed and all discounts have been applied in order to receive the $75 Reward which expires 30 days after the date of issue for Member Status Tiers, 50 days for Silver Status Tiers, 80 days for Rose Gold Status Tiers and 130 days for Black Status Tiers.79. Members with 'Member Status' are eligible to receive the following Rewards and Benefits:

3. through The Iconic;85. Rewards can only be redeemed on purchases of Mimco merchandise made at:
1. Mimco retail boutiques;
2. Mimco’s Website;
3. Mimco’s App;
4. Mimco outlet stores; and
5. David Jones stores in Australia where Mimco product is available for purchase.86. Rewards cannot be redeemed on purchases of Mimco merchandise made at:
1. Myer stores in Australia.
2. David Jones’ websites;
3. Myer’s websites;
4. through The Iconic;
5. through any other channel not expressly listed in clause 83.87. Rewards may only be redeemed on presentation of the MIMCollective Card or corresponding photo identification and online on the Website.
88. When redeeming any applicable Reward, the Reward will be applied proportionally across each item purchased, based on the percentage each item represents of your total purchase. This will mean that the Reward will not be split equally across all items.
89. In certain instances, there may be conditions applicable to redemption of Rewards as notified or as set out in promotional terms and conditions.
90. Rewards cannot be redeemed against purchases of the Mimco x Our Watch collection.
91. All Rewards have an expiry date as dictated by the Rewards in each tier at which point they will no longer be available for redemption. Mimco reserves the right to change the expiry date of any Reward at any time without notice.
92. Only Rewards from one MIMCollective Card can be redeemed per transaction.
93. Mimco will not be held responsible or liable if Rewards are not able to be redeemed for whatever reason but specifically, in the case of a Technical Issue including without limitation the failure of software or hardware or an EFTPOS malfunction.
94. Rewards can only be redeemed once.
95. Mimco reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Rewards.
96. When purchasing using a Buy Now Pay Later provider (like Afterpay or Klarna), Rewards can be redeemed at the initial transaction, but cannot be used in making subsequent provider payments.
97. Returns: If a customer wishes to return a purchase for reasons other than that the goods are faulty or misdescribed:
i. any Reward redeemed or utilised during the purchase will be forfeited; and
ii. any Reward that may otherwise have been obtained (such as through being promoted to a higher tier) will be kept but the Member will have the value of the return transaction deducted from their Spend Balance. This may result in the Member having a negative Spend Balance or Tier Balance.98. Exchanges: If a customer wishes to exchange a purchase for reasons other than that the goods are faulty or misdescribed, any Reward redeemed or utilised during the original purchase may be honoured in the course of an exchange, if:
i. that exchange takes place on the same day as the original purchased item(s) are returns; and
ii. the exchange item(s) are of equal or greater value than the value of the original purchased item(s) prior to any discount(s) and/or reward(s) applied, and otherwise will be forfeited.
